Does the History of Our Field Matter to Us ADR Types?

I have stood in lines, at SPIDR, ACR and other ADR events, listening to new ADR practitioners talking enthusiastically about their field, as if the field started the day they discovered it. They display no awareness of ADR’s long history. This blind spot, however, is not exclusive to the new arrivals. Many long time practitioners limit their knowledge of ADR history to their own personal history.

Michael Collins recognized that, whatever the morality of importing a zillion malcontent scots and dissipate younger sons of the aristocracy into Ireland in order to run things, it had happened, and that those people couldn’t simply be shipped back to England, or killed. He also recognized that England wasn’t going to give the Irish a Republic in 1921, no matter how much they were entitled to one. So he took a raw deal, because it was the best deal he could get. Now Ireland is richer than Britain, and has not only a Republic, but also better beer. It is hard to overrate the courage of this decision. When he signed the agreement, in the wee small hours of the morning, he turned to Lord Birkenhead and quietly said “I have signed my death warrant.” As he had. He was shot less than a year later by anti-treaty forces.

It is easy to forget, when negotiating as a lawyer or in business, that political negotiators often have their lives as one of the stakes.

In a recent column, “Absolute Confidentiality: Is It Wise?,” I noted that California’s Mediation Confidentiality Statute, Evidence Code 1115 et seq., bars all evidence of, among other things, attorney malpractice that takes place in the course of a mediation and, therefore, functions as an immunity statute as well. An attorney’s lack of accountability in tort for malpractice that takes place during a mediation will ultimately make clients wary of allowing their attorneys to use mediation.

As to Mosten’s book: “A complete (how is it that he misses nothing?) and practical guide filled with brilliant ideas, useful tools, ‘just go do it’ insights, and invaluable advice for all.” (Daniel Bowling, executive director, Association for Conflict Resolution).

I have never had anyone who was not very happy with either book. Much to my surprise, in a class I assigned Marketing Without Advertising to, all post-graduate students, MWA was the one book they found more important than any other they had read in their post graduate program. Importantly, Mediation Career Guide applies everything with specific details for a mediation career, missing nothing, warning you of everything you need to be aware of.

For anyone who wants to make mediation a career, I can recommend both books very strongly.
